Privacy Policy

1. Controller

The controller responsible for data processing on this website is:

FAUN Live Band GbR
represented by Oliver Pade
Schulstr. 9
82166 Gräfelfing
Germany
Email: management@faun-music.com

2. General

We only process personal data where this is necessary for a working website and our content, or where you have given your consent. The legal bases are mainly Art. 6(1)(a) GDPR (consent), (b) (contract and pre-contractual requests), (c) (legal obligation) and (f) GDPR (legitimate interest). Where information is stored on or read from your device, Section 25 of the German Telecommunications Digital Services Data Protection Act (TDDDG) also applies.

3. Hosting and server log files

This website is hosted by Vercel Inc., 440 N Barranca Avenue #4133, Covina, CA 91723, USA. Each time a page is requested, Vercel automatically processes technical data sent by your browser: IP address, date and time, the page requested, referrer, browser and operating system. This is necessary to deliver the website securely and reliably (Art. 6(1)(f) GDPR). The log data is deleted automatically after a short time.

Vercel processes the data on our behalf (Art. 28 GDPR). Transfers to the USA are based on the EU-U.S. Data Privacy Framework, in which Vercel participates, and on the European Commission’s Standard Contractual Clauses. More information: vercel.com/legal/privacy-policy

4. Content and images (Sanity)

We manage this website’s content with the content management system Sanity (Sanity AS, Oslo, Norway, and Sanity US Inc., USA). Images are delivered through Sanity’s content delivery network (cdn.sanity.io). Your IP address is sent to Sanity so that the images can be delivered to your browser (Art. 6(1)(f) GDPR). Sanity processes the data on our behalf. More information: sanity.io/legal/privacy

5. Cookies and consent

On your first visit, a cookie banner asks which cookies you allow. We store your choice in strictly necessary cookies on your device (viewed_cookie_policy, CookieLawInfoConsent and cookielawinfo-checkbox-…) for 12 months each. The legal basis is Section 25(2) no. 2 TDDDG together with Art. 6(1)(c) GDPR, because we have to be able to prove your consent.

We only use all other cookies and services if you have consented (Section 25(1) TDDDG, Art. 6(1)(a) GDPR). You can change or withdraw your choice at any time with effect for the future, using the “Cookie settings” link at the bottom of every page.

6. Meta Pixel (Facebook and Instagram)

Only if you accept the “Advertisement” category in the cookie banner do we use the Meta Pixel of Meta Platforms Ireland Ltd., Merrion Road, Dublin 4, D04 X2K5, Ireland. It lets us measure how well our ads on Facebook and Instagram perform and show them to the right people. The pixel sets the cookie _fbp (stored for up to 90 days) and sends data such as your IP address, browser information, the pages you visit and a cookie ID to Meta. Meta may link this data to your Facebook or Instagram account and also use it for its own purposes.

We and Meta are joint controllers for collecting this data and transmitting it to Meta (Art. 26 GDPR). You can find the agreement here: facebook.com/legal/controller_addendum. Meta may transfer data to the USA and is certified under the EU-U.S. Data Privacy Framework. The legal basis is your consent (Art. 6(1)(a) GDPR, Section 25(1) TDDDG). More information: facebook.com/privacy/policy

7. YouTube videos

Some pages show videos from YouTube (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland). We deliver the preview images from our own server, so no data is sent to YouTube for them. Only when you click a video is the YouTube player loaded in privacy-enhanced mode (youtube-nocookie.com). From that moment on, Google receives data such as your IP address and information about your browser, and may store cookies or similar technologies on your device. Google may transfer data to the USA and is certified under the EU-U.S. Data Privacy Framework. The legal basis is the consent you give by clicking the video (Art. 6(1)(a) GDPR, Section 25(1) TDDDG). More information: policies.google.com/privacy

8. Newsletter

We send our newsletter with Mailchimp (The Rocket Science Group LLC d/b/a Mailchimp, an Intuit Inc. company, Atlanta, USA). When you sign up, we send your email address and the language of the page to Mailchimp. You then receive an email with a confirmation link, and your sign-up is only complete once you click it (double opt-in). To be able to prove your sign-up, Mailchimp stores the time of sign-up and confirmation and the IP address used for the confirmation. Mailchimp may also record whether a newsletter was opened and which links in it were clicked.

The legal basis is your consent (Art. 6(1)(a) GDPR). You can unsubscribe at any time using the link in every email. We keep your data until you unsubscribe. Mailchimp processes the data on our behalf and is certified under the EU-U.S. Data Privacy Framework. More information: mailchimp.com/legal/privacy

9. Contact form and email

When you write to us through the contact form, we process your name, email address and message in order to answer your request (Art. 6(1)(b) GDPR for requests related to a contract, otherwise Art. 6(1)(f) GDPR). The message is delivered to us as an email through the email service Resend (Plus Five Five, Inc., USA). The website itself does not store it. Resend processes the data on our behalf and is certified under the EU-U.S. Data Privacy Framework. More information: resend.com/legal/privacy-policy

The same applies if you email us directly. We delete your request once it has been dealt with, unless statutory retention obligations require us to keep it.

10. Links to other websites

We link to ticket shops, our merch shop, streaming services and our social media profiles. These are plain links: you only reach the other provider once you click one, and that provider’s privacy policy then applies.

11. How long we keep data

We only keep personal data for as long as it is needed for the purpose in question or as required by statutory retention periods. Data we process based on your consent is kept until you withdraw your consent.

12. Your rights

You have the right to:

  • access the data we hold about you (Art. 15 GDPR)
  • have incorrect data corrected (Art. 16 GDPR)
  • have your data deleted (Art. 17 GDPR)
  • restrict processing (Art. 18 GDPR)
  • data portability (Art. 20 GDPR)
  • withdraw your consent with effect for the future (Art. 7(3) GDPR)

Right to object: where we process data based on a legitimate interest (Art. 6(1)(f) GDPR), you can object to the processing at any time on grounds relating to your particular situation (Art. 21 GDPR).

An email to management@faun-music.com is all it takes. You can also lodge a complaint with a data protection supervisory authority, for example the authority responsible for us, the Bavarian Data Protection Authority (BayLDA) in Ansbach: lda.bayern.de

13. Encryption

This website uses SSL/TLS encryption, so data you send to us, for example through the contact form, cannot be read by third parties.
